DEFINITIONS
'TBC, Buffalo, the Business, the management, Us, Our, We all refers to The Buffalo Club.
'You, Your, Player, Player's' refers to the invested Players backed under the terms of the poker investment programme.
'PIP' refers to the Poker Investment Programme run by The Buffalo Club.
'DIV' refers to a Player's Daily Invested Value under the PIP.
'P&L' refers to a Player's individual Profit & Loss account from all play under the PIP as monitored by TBC.
'Sweep' refers to the process of sweeping any profit balance (including a zero balance) from an online poker account during, or at the end of a playing session.

PLAYER IDENTIFICATION
All Players on the PIP are required to provide two forms of identification; 1 x Primary ID & 1 x Secondary ID. Primary ID is one of the following – Passport or Full Drivers License with photo.
Secondary ID is one of the following – Utility bill that is less than 2 months old or Bank Statement less than 1 month old. Players must inform TBC of any change of address at the point of change.
All ID provided will be photocopied and provided to our online poker partners where required.
TBC also requires full bank details of its Players (in order to transact profit payments).
TBC requires full contact details to include phone number, email address, MSN Messenger ID, Skype address etc.

PLAYER COMMITMENT
TBC expects its cash Players to play an absolute minimum of 15,000 hands per calendar month (or 750 hands per day played and minimum of 20 days per month). Failure to do so will result in an activity review and possible termination from the PIP. This is not a target figure but a minimum requirement which should be surpassed by a Player who takes their place on the PIP seriously.

TBC expects its MTT & SNG Players to play an absolute minimum of 600 games per calendar month (or 30 games per day played and a minimum of 20 days per month). Failure to do so will result in an activity review and possible termination from the PIP. This is not a target figure but a minimum requirement which should be surpassed by a Player who takes their place on the PIP seriously.

PROFIT SHARE TERMS
TBC will split Player generated profit 50:50 with the Player, meaning 50% of the total profit figure is due to TBC and 50% will be applied to the Players P&L balance. Not all of the total profit figure is accessible whilst remaining on the PIP. Please see the Payment of Profits section for further details.

PROFIT & LOSS
TBC will manage a true P&L account for each Player.
Players are required to sweep all profits back to the nominated TBC originating account at the end of each playing session.
Along with the profit sweep, Players are also required to send a daily email containing their profit or loss figure for the session along with a screen shot of their Cashiers lobby and a screen shot of their past transactions page; showing the transfer which they are submitting.
Any discrepancy between the submitted balance and what we receive will be credited or discussed as appropriate.
Failure to sweep and submit emails before 10am will result in termination from the PIP.
All profits/losses will be logged upon each Players individual P&L.
Playing accounts will be replenished for loss values before 11am the following day.
TBC will provide P&L payment statements twice per month.

PAYMENT OF PROFITS
A profitable Player will be eligible for payments on the 1st and 16th calendar day of each month subject to the following points:

The minimum payment that will be processed for payment is $100.
The profit payment will be calculated before DIVs are sent on the 1st & 16th of each month and will be sent for payment that day. If any profits are lost back during the period between calculation and payment being sent (a matter of hours) then adjustments will be made accordingly.
TBC's payment structure is as follows (all % shown are a sub figure of the total 50% P&L figure that the Player is due in total and therefore do not represent a % of the total P&L but instead a % of the Players 50% of the total P&L):
Month 1 – 50% part payment to the Player (50% carried over)
Month 2 – 75% part payment to the Player (25% carried over)
Month 3 and thereafter – 90% part payment to the Player (10% carried over and due upon exit from programme)
100% payment is available once a Player has generated 40x his/her starting DIV value as total profit.
TBC commits to pay all monies due to Players as detailed above except in circumstances of fraud or other dispute, at which point payment will be withheld until the dispute is resolved, if necessary by an independent arbitrator.

INCREASING OF PLAYERS INVESTED VALUE (DIV)
TBC will invest in its Players based upon ongoing performance. Perform well and you will be invested in more heavily.
A Players invested value is subject to change at any time and without prior written notice or Player consent.

MONITORING
All playing machines must have TEAMVIEWER installed to allow TBC management to monitor your activity at any given time. TEAMVIEWER can be downloaded for free at http://www.teamviewer.com/en/download/tv6.aspx

CRITICAL CONTRACT RULES
Players caught attempting to defraud TBC of DIV's will be immediately terminated from the PIP and legal action will be brought against the Player concerned wherever possible.
Players must not lose more than 50% of their DIV ever.
Losses equivalent to 2x your DIV in any 7 day period will result in a performance review and a cooling off period to be determined by the management.
Losses equivalent to 5x your daily invested value ever will result in a performance review and likely termination from the PIP, to be determined by the management.
Players must not take part in cash games against other PIP funded Players.

TERMINATION FROM THE POKER INVESTMENT PROGRAMME
The decision of the management to terminate a Player from the PIP is final.
All profit balance monies due to a Player upon termination will be paid through the normal methods to the Players poker account in USD, except in the case where fraudulent activity is suspected or proven.
If the reason for termination from the PIP is suspected or proven fraud, TBC reserves the right to suspend payment until a fair and proper investigation into any fraudulent or potentially fraudulent activity has been undertaken. TBC's decision upon such matters is final.

THIRD PARTY AGREEMENTS
TBC Players are not permitted to enter into any third party sponsorship or staking arrangements whilst on the PIP without first having obtained written consent from the TBC management.
Any Player found to have other third party staking arrangements will be terminated from the PIP.

IMAGE RIGHTS MARKETING
TBC reserves the right to use the image, name or nicknames of its invested Players who are currently on the PIP or who have been on the PIP within the last 24 months for the explicit purposes of marketing its own business and business activities.
No information, digital assets or Player details will be passed by TBC to any third party organisation for the purpose of marketing of any kind without prior written consent being obtained from the Player.

LIABILITY
TBC does not accept any liability for the loss of accrued profit by a Player within a Playing session before a sweep has taken place.
The only liability for losses that TBC accepts is the loss of a Players DIV as funded by TBC except in the circumstance of fraudulent behaviour on the part of the Player.
The liability for fraudulent losses will be transferred to the Player in such circumstances and TBC will pursue such losses with legal action wherever possible.
